These Terms & Conditions and Customer Policies apply to purchases made directly through the Leo & Lexi website. They are intended to be read together as one combined set of website terms and policies.
1.1 About Leo & Lexi
Leo & Lexi is operated by Mydas Industries Pty Ltd, ABN 18 663 056 148. In this document, “Leo & Lexi”, “we”, “us” and “our” refer to Mydas Industries Pty Ltd trading as Leo & Lexi.
For customer support, please contact us through our Contact Us page or at support@leoandlexi.com. We do not accept returns at any business, registered or mailing address unless we have provided written return instructions.
1.2 Acceptance of these Terms
By accessing our website, creating an account, placing an order, submitting content, contacting us, or otherwise interacting with Leo & Lexi online, you agree to these Terms & Conditions and Customer Policies. If you do not agree, please do not use our website or place an order through the website.
1.3 Website purchases only
These Terms apply only to purchases made directly through the Leo & Lexi website. Purchases made through Amazon or any other third-party marketplace are subject to that marketplace’s own terms, policies, shipping, returns, refunds and customer service procedures.
Customers outside Australia may be shown product information, regional pricing, or third-party purchase links for convenience. Displaying product information or a third-party purchase link does not mean we offer direct website checkout, shipping, returns, refunds, or customer service in that country.
United States customers may browse the Leo & Lexi website and may be directed to Amazon USA using “Buy on Amazon” or similar links. Orders placed through Amazon USA are handled by Amazon and are not website orders under these Terms.
1.4 Eligibility and adult use
The website is intended for use by adults aged 18 years and over. By using the website or placing an order, you confirm that you are at least 18 years old and have authority to enter into these Terms.
Our products are intended for responsible adult purchase and setup. They are not toys and should not be assembled, installed, handled or used by children without adult supervision.
1.5 Website accounts and guest checkout
Customers may be able to create an account or check out as a guest. You are responsible for keeping your account login details secure and for ensuring that all account, billing and delivery information you provide is accurate, complete and current.
We may suspend, restrict or close accounts where we reasonably believe there has been fraud, abuse, chargeback abuse, harassment, misuse of policies, misuse of promotions, unlawful activity, or breach of these Terms, where permitted by law.
1.6 Wholesale, trade and B2B purchases
Our website is intended for consumer purchases and standard retail orders. Wholesale, trade, distributor, commercial, or B2B purchases are not available through standard website checkout unless we expressly agree otherwise in writing.
Wholesale, trade, distributor, commercial, or B2B purchases may be subject to separate written terms. If there is any inconsistency between these Terms and a written wholesale agreement, the written wholesale agreement will apply to that B2B purchase.
1.7 Orders
When you place an order, you agree that all information you provide is accurate, complete and current. An order confirmation email confirms that we have received your order. A contract for the sale of goods is formed when your order is dispatched, unless applicable law requires otherwise.
We reserve the right to accept, decline, cancel, limit or hold an order where permitted by law, including where there is a stock error, pricing error, payment issue, suspected fraud, unusually high-risk order, freight-forwarding address, website error, delivery restriction, or misuse of discounts or promotions.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item, subject to applicable law.
1.8 Pricing, currencies, taxes and payment
Prices may be displayed in different currencies depending on customer location, website settings, or third-party marketplace links. Website checkout is currently available for Australian orders only. Prices, shipping, taxes, returns, refunds and order handling on Amazon or other third-party marketplaces are controlled by the relevant marketplace listing and policies.
For Australian website orders, prices are shown in Australian dollars unless otherwise stated. Taxes and any applicable charges are shown or calculated at checkout. Prices, product availability, promotions, shipping offers and discounts may change without notice, subject to applicable law.
Payment must be authorised before we process your order. We may accept payment through Shopify-supported payment methods and Afterpay, subject to availability and any third-party payment provider terms.
1.9 Promotions and discount codes
Promotions, discount codes, coupon codes, trial offers and special offers are subject to the specific terms stated with the offer. Unless we state otherwise, discount codes cannot be combined, cannot be applied after an order has been placed, have no cash value, and may be limited by product, country, customer, order value or time period.
We may cancel or refuse orders where a promotion or discount code has been misused, shared in breach of its terms, obtained fraudulently, or applied due to a technical error, where permitted by law.
1.10 Product information and availability
We aim to describe and display our products as accurately as possible. However, product images, colours, dimensions, materials and finishes may vary slightly due to photography, lighting, screen settings, manufacturing updates, natural material variation, and handmade or hand-finished components.
Unless expressly stated on the product page, lifestyle props, decor items, cats, tools, accessories and other items shown in product images are not included with the product. Each product design is different; cushions, beds, accessories and other components are included only where expressly stated on the product page or in the product listing.
Product measurements are approximate. Product specifications, materials, included parts and design details may be updated from time to time without notice, provided this does not limit any rights that cannot be excluded under applicable law.
1.11 Natural materials and product variation
Some Leo & Lexi products use natural or naturally derived materials, including wood, cattail, sisal and soft fabrics. Natural variations in grain, shape, tone, weave, texture, thickness, knots, markings, colour and finish are normal and are not considered defects unless they materially affect the safety, structure, function or quality of the product.
Because our products are designed with natural textures and cat-friendly materials, normal scratching, rubbing, compression, shedding, wear and ageing may occur over time.
1.12 Website misuse and prohibited conduct
You must not misuse our website, interfere with its operation, attempt to access restricted areas, use bots or scraping tools, copy our content for commercial use, submit false information, engage in fraud, or use the website in a way that may harm Leo & Lexi, our customers, our service providers or any third party.
We may limit, cancel, or refuse orders that appear to involve fraud, abuse of promotions, chargeback abuse, bot activity, scraping, automated purchasing, policy manipulation, harassment, or unauthorised resale, where permitted by law.
2.1 Cats only
Leo & Lexi products are designed for cats only. They are not designed for dogs, children, adults, or any other unintended use. Customers are responsible for assessing whether a product is suitable for their cat’s size, weight, health, mobility, temperament, climbing ability and behaviour.
Customers must check the product page for applicable product weight limits before purchase and use.
2.2 Assembly required
All Leo & Lexi cat furniture products require adult assembly unless expressly stated otherwise. You are responsible for reading and following all assembly instructions, product warnings, care instructions, wall-fixing recommendations and safety guidance provided with the product or on our website.
Small parts may be present during assembly. Keep small parts, packaging materials and tools away from children and pets during assembly.
2.3 Wall fixing and stability
All Leo & Lexi cat trees should be wall-secured for added stability. Wall fixing hardware is not included. Customers are responsible for choosing suitable wall fixing hardware for their wall type, installation surface, household environment and intended use. If unsure, customers should seek advice from a qualified tradesperson.
Failure to secure a cat tree where recommended may increase the risk of tipping, instability, injury or property damage, especially with larger cats, active cats, multiple cats, uneven flooring, or high-energy play.
2.4 Safe placement and supervision
You agree to place the product on a flat, stable, dry indoor surface and to keep it away from hazards such as fireplaces, heaters, balconies, open windows, stairs, wet areas, unstable surfaces and outdoor conditions. Leo & Lexi products are indoor-only unless expressly stated otherwise.
You should supervise your cat when introducing a product for the first time and monitor whether the product is suitable for your cat’s behaviour, size and climbing style.
2.5 Inspection and maintenance
You agree to regularly inspect screws, bolts, joints, baskets, platforms, sisal, fabric, cushions and other parts. Stop using the product immediately if it becomes damaged, unstable, cracked, loose, heavily worn, unsafe, or unsuitable for your cat.
To the extent permitted by law, Leo & Lexi is not responsible for damage, injury, loss, wear, failure or instability caused or contributed to by incorrect assembly, failure to follow instructions, misuse, modification, outdoor use, lack of maintenance, unsuitable placement, overloading, or use by animals or people for whom the product was not designed.
3.1 Website shipping area
Leo & Lexi website checkout and direct website shipping are currently available for Australian orders only. We do not ship website orders internationally. Customers outside Australia may be directed to third-party marketplaces such as Amazon.
3.2 Free standard shipping in Australia
We offer free standard shipping on eligible Australian website orders unless stated otherwise at checkout or in a specific promotion. Free shipping applies to the initial outbound delivery for eligible Australian website orders and does not include return shipping for change-of-mind returns or 30-day trial returns.
3.3 Dispatch and delivery estimates
We aim to dispatch Australian website orders within 1–2 business days. Estimated delivery within Australia is usually 2–7 business days after dispatch, depending on location, carrier availability and delivery conditions.
Delivery timeframes are estimates only unless expressly stated as guaranteed. Delays may occur due to carrier issues, weather, peak periods, operational disruption, address issues, public holidays, natural disasters, strikes, supply chain issues, or events outside our reasonable control.
3.4 Delivery addresses
You are responsible for providing a complete and accurate delivery address. We do not ship website orders to PO boxes, parcel lockers or addresses that our carriers cannot service.
We are not responsible for delays, failed deliveries, returned parcels, or lost parcels caused by incorrect, incomplete, unsafe or outdated address information provided by you, subject to rights that cannot be excluded by law.
3.5 Tracking and carriers
We use various carriers depending on order size, location and service availability. Tracking will be provided where available. Some deliveries may require a signature or other delivery confirmation depending on the carrier, order value or delivery location.
3.6 Returned-to-sender orders
If an order is returned to us because of an incorrect address, failed delivery, refusal of delivery, failure to collect, or another customer-related reason, we may deduct reasonable original shipping, return shipping and handling costs from any refund, where permitted by law.
If you would like the order resent, additional delivery charges may apply.
3.7 Delivered but not located
If tracking shows delivered but the parcel cannot be located, please first check the delivery location, household members, neighbours, building reception, safe-drop locations and the carrier’s tracking information. Contact us promptly so we can assist with a carrier enquiry where reasonably possible.
We are not responsible for loss caused by an incorrect address, unsafe delivery location, failure to collect, or circumstances outside our reasonable control, subject to rights that cannot be excluded by law.
3.8 Delivery damage, missing parts and transit issues
Please report delivery damage, missing parts or transit issues within 3 business days of receiving the package where possible. Do not assemble the product, and keep the original packaging intact, as this helps us investigate with the carrier and assess the issue.
This reporting timeframe does not limit any rights you may have under Australian Consumer Law or other applicable laws.
4.1 Availability
Replacement parts may be available for selected Leo & Lexi products and are subject to availability. Currently, replacement baskets may be available for specified Leo & Lexi models.
4.2 Compatibility
Replacement baskets and replacement parts are designed only for the specific Leo & Lexi models stated in the product listing. You are responsible for checking model compatibility before purchase.
Replacement baskets do not include cushions, hardware, tools or accessories unless expressly stated on the product page.
4.3 Modifications and repairs
Customers may choose to refresh or replace sisal rope themselves, but Leo & Lexi does not currently sell replacement sisal rope. Modifying, repairing, replacing, or altering parts of the product, including replacing sisal rope yourself, may void warranty coverage for any issue caused or contributed to by that modification.
5.1 Reviews and website-submitted content
If you submit reviews, photos, videos, comments, feedback, testimonials or other content directly through our website, review tools, email, or customer support channels, you confirm that the content is accurate, based on your genuine experience, and that you own the content or have permission to share it.
By submitting content directly to us or through our website tools, you grant Leo & Lexi a non-exclusive, royalty-free, worldwide permission to use, reproduce, edit, publish, display, distribute and share that content for Leo & Lexi marketing, website, email, social media and promotional purposes, unless you tell us otherwise in writing.
5.2 Social media content
If you tag Leo & Lexi or share content about our products on social media, we may contact you to request permission before reposting or using that content, especially for paid advertising. We may not be able to control how third-party social media platforms display, share or process your content.
5.3 Prohibited user content
You must not submit content that is false, misleading, fake, abusive, offensive, defamatory, unlawful, spam, promotional, competitor-driven, infringing, or unrelated to our products. We may remove, reject or edit user content where permitted by law.
5.4 Intellectual property
The Leo & Lexi brand name is trademarked. Our website content, product names, images, videos, copy, graphics, icons, layout, brand materials and other content are owned by or licensed to us and are protected by intellectual property laws.
You must not copy, reproduce, download, modify, scrape, distribute, display, sell, imitate, reverse engineer, or use our content, branding, product images, product descriptions, website design, or other materials for commercial purposes without our written permission. Nothing in these Terms transfers ownership of any intellectual property rights to you.
Our product designs are not described as patented or design-registered unless we expressly state otherwise in writing.
Giveaways, competitions, promotions, contests and similar campaigns may be subject to separate terms and conditions. Those separate terms may include eligibility rules, country or state restrictions, prize details, start and end dates, winner selection, disqualification rules, shipping rules, privacy terms and platform disclaimers.
Unless expressly stated otherwise, Leo & Lexi giveaways and promotions are not sponsored, endorsed, administered by, or associated with Instagram, Facebook, TikTok, Amazon, or any other third-party platform.
7.1 Third-party links and services
Our website may contain links to third-party websites, platforms, payment providers, shipping providers, social media platforms, review tools or other services. We are not responsible for third-party websites, policies, content, security, availability, errors or practices. Your use of third-party services may be subject to their own terms and policies.
7.2 Limitation of liability
To the maximum extent permitted by law, Leo & Lexi is not liable for indirect, incidental, special, consequential, exemplary, or punitive loss or damage, including loss of profit, loss of opportunity, loss of data, loss of goodwill, business interruption, emotional distress, or other indirect loss.
To the maximum extent permitted by law, our total liability arising out of or in connection with your use of the website or purchase of a product is limited to the amount you paid for the relevant product.
Nothing in these Terms excludes, restricts, or modifies any right, guarantee, remedy, or liability that cannot lawfully be excluded, restricted, or modified, including under Australian Consumer Law.
7.3 Indemnity
To the extent permitted by law, you agree to indemnify Leo & Lexi against loss, damage, cost, expense, claim, or liability arising from your breach of these Terms, misuse of our website, misuse of our products, infringement of third-party rights, unlawful conduct, or false information provided by you.
7.4 Force majeure
We are not responsible for delay or failure to perform our obligations where caused by events outside our reasonable control, including natural disasters, extreme weather, fire, flood, pandemic, strikes, labour disruptions, transport disruption, customs delays, war, civil unrest, government action, cyber incidents, supply chain disruption, carrier delays, or failure of third-party service providers.
7.5 Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on our website with the updated date. The Terms that apply to your order are the Terms in effect at the time you place your order, unless a change is required by law.
7.6 Governing law
These Terms are governed by the laws of Queensland, Australia. You agree that disputes will be handled by the courts or tribunals of Queensland, Australia, subject to any rights you may have under applicable consumer protection laws.
7.7 Dispute resolution
Before starting legal proceedings, you agree to contact us first so we can try to resolve the issue in good faith. This does not prevent either party from seeking urgent relief where required or exercising rights that cannot be excluded by law.
7.8 Severability
If any part of these Terms is found to be invalid, unlawful, or unenforceable, that part will be read down or removed to the extent necessary, and the remaining parts will continue to apply.
